WHAT MAKES A GOOD MEDICAL MALPRACTICE CASE?

  1. Serious Injury - First and foremost, the injury or injuries at issue must be serious or catastrophic. Examples include (but are not limited to):
    • Brain injury causing significant cognitive, sensory, motor, and/or behavioral impairments.
    • Complete spinal cord injury
    • Incomplete spinal cord damage causing substantial sensory, motor, or other functional limitation
    • Other physical injuries that seriously limit important life functions
    • Organ failure
    • Serious and/or large burns
  2. Permanent injury - In today's jury environment, injuries must generally be permanent to justify the filing of a lawsuit, particularly in the context of medical malpractice. We strongly advise our clients not to proceed with medical malpractice litigation unless the serious injuries they have suffered are very likely to affect them for the foreseeable future. It is usually unwise to file a medical malpractice lawsuit where the injuries - no matter how serious - are subject to anything close to a complete cure.
  3. Egregious misconduct - Simple negligence on the part of a physician or hospital often does not suffice to secure an adequate financial award. Strong medical malpractice cases will frequently involve blatant misconduct on the part of a physician or hospital.

Moreover, it is not enough for your lawyer in a medical malpractice lawsuit to simply argue that a defendant doctor was negligent. Another physician must be willing to testify that the conduct of the defendant doctor fell below the accepted standard of care. Other facts should make clear that the medical negligence at issue - and not some other circumstance such as a chronic disease - caused your injuries.
